CONVEYANCE
Of freehold land and hereditaments situate at Green Oak in the Township of Totley in the County of Derby.

THIS CONVEYANCE made the 27th day of February 1929 BETWEEN JOHN THOMAS CARR of Lemont Road Green Oak Totley in the County of Derby Out of Business (hereinafter called "the Vendor") of the one part and THE RURAL DISTRICT COUNCIL FOR THE RURAL DISTRICT OF NORTON IN THE COUNTY OF DERBY (hereinafter called “the Council”) of the other part WHEREAS the Vendor is seised in fee simple in possession free from incumbrances of the land and hereditaments hereinafter described and intended to be hereby conveyed AND WHEREAS on the 19th day of October 1928 the Minister of Health under the powers conferred upon him by Section 276 of the Public Health Act 1875 made an order (number 72955) directing the provisions of Section 164 of the Public Health Act 1875 to be in force via the Contributory Place of Totley aforesaid AND WHEREAS the Council being desirous of acquiring the said land and hereditaments for the purpose of a public pleasure ground have agreed with the Vendor for the purchase of the said land and hereditaments and the fee simple thereof in possession free from incumbrances at the price of £1,550 NOW THIS DEED WITNESSETH that in pursuance of the said agreement and in consideration of the sum of £1,550 now paid by the Council to the Vendor (the receipt whereof the Vendor hereby acknowledges) the Vendor as beneficial owner hereby conveys unto the Council FIRST ALL those two pieces of land situate at or near Green Oak in the township of Totley in the County of Derby called respectfully “The Red Wells" containing 4a. 1r. 39p. or thereabouts and the "Gilling Storth” containing 4a 0r. 4p. or thereabouts and now in the occupation of the Vendor and more particularly delineated and described on the plan drawn on their presents and thereon coloured pink AND SECONDLY ALL that piece of land (formally part of a close of land called the “Upper Breast Barns") adjoining the hereditaments first hereinbefore described or some part thereof situate on the Southerly side of Lemont Road in the Township of Totley aforesaid containing in the whole 285 superficial square yards or thereabouts together with the buildings and erections now erected thereon and more particularly delineated and described in the said plan and thereon coloured green TO HOLD unto the Council in fee simple subject to and with the transfer to the Council all rights of drainage as the same now exists AND the Vendor hereby acknowledges the right of the Council to production and delivery of copies of an Indenture dated the 21st day of January 1908 and made between Benjamin Thorpe of the one part and the Vendor of the other part and hereby undertakes the safe custody thereof IN WITNESS whereof the Vendor has hereunto set his hand and seal and the Council have caused their Seal to be hereunto affixed the day and the year first before written.
